Dear Cornwall Council,

Re : Homechoice Property Ref : 17960, wilfully misleading
description and image ?

Thank you for you reply of 23 March to my Freedom Of Information
request of 24 February 2015.

I regret I am dissatisfied with your response and request a review.

The FOI request of 24 February 2015 related to recorded information
provided on your website which I found to be misleading and
erroneous and not in the public interest.

That the FOI request sought information from the Council to
determine if a complaint would be appropriate. I regret the
information provided by Anna Brooks, Housing Options Service
Improvement Manager, has only raised even more concerns about the
way the Council responded to the FOI request and it's erroneous
recorded information on and after 24 February 2015.

Whilst I accept a 'mistake' had been made I regret the erroneous
and recorded misleading information remained on the Council's
website to further mislead Homechoice bidders up until midnight the
following day which I consider to be wilfully misleading.

Ms Brooks explanation that the nominated applicant will be given an
opportunity to view before accepting the tenancy and can refuse the
tenancy without jeopardising their position on the housing register
if they felt they had been 'misinformed' or it was not suitable, as
being outrageous. That in someway Cornwall Council finds it
acceptable to provide recorded misinformation on it's website
because the applicant, having been wilfully 'misinformed', can
always say no.

On the issue of the accuracy of recorded information appearing on
the Council's website with regard to advertised properties on
Homechoice, Simon JR Mansell MBE, Principal Legal Officer Corporate
Governance, Legal Services, for and on behalf of Cornwall Council,
has stated "If errors are pointed out to us we ask the Registered
Provider to supply the correct information as a matter of urgency",
unquote. Clearly this is not the case given that Cornwall Council
is itself the Registered Provider of Property Ref : 17960.

Cornwall Council is aware I write a blog every week about the weekly
Homechoice advertisements and I have now done so for some 38 weeks.
Much I what I have to say is in response to Cornwall Council's
unwillingness to accept responsibility for what it's Registered
Providers, it's housing partners, and itself, records on it's
website which is misleading or unhelpful and is not therefore in
the public interest.

Precisely why I would prefer the Information Commissioner
consider my FOI request than have Cornwall Council railroad it for
an internal cover-up.
